What is President Obama thinking by nominating Solicitor General Elena Kagan, who has zero judicial experience, to take the place of retiring Justice Stevens? The right has already come out swinging against his choice. His actions amount to a "Hail Mary" pass in the end zone, hoping for a touchdown. Though her resume is impressive, she has zero judicial experience, never argued a case before the Supreme Court or any appeals court before she became solicitor general a year ago. Additionally, she has two years of private law practice. Wow, she fast-tracked it to SCOTUS. There's another issue that will certainly rile the gay and lesbian community. Her position on gays in the military is worth questioning. She came under strong criticism for her efforts to block military recruiters from Harvard because of the military's "don't ask, don't tell" policy.
Would you send a pediatrician to do the job of a neurosurgeon? I think not. I am sure the confirmation hearings will be very robust and possibly caustic. There were so many other candidates the president could have picked, rather than Ms. Kagan. I would be remiss in ignoring the fact that she clerked for Thurgood Marshall, worked for President Bill Clinton and earned an excellent reputation as a teacher and manager in the Ivy League world. Unlike Justice Sotomayor, she was already vetted, with modest Republican support, when she was confirmed as solicitor general, so a protracted confirmation fight isn't likely.
Kagan was the first female dean of Harvard Law School and she was the first woman to serve as the top Supreme Court lawyer for any administration, but I still can't get pass the fact that she has no judicial experience.
