David Earls, Child Rapist, Gets 19 Years of 20-Year Sentence Suspended by Judge Thomas Bartheld, This is a Gross Miscarriage of Justice

Could someone please tell me why a judge would suspend 19 years of 20-year sentence David Earls, of a known sex offender, who raped a four-year old girl? This is a prime reason why voters should take the time to read about these judges who are being elected in some jurisdictions across the country. The defendant also got credit for the nine months that he served since being arrested. It sounds like the prosecution hinged on the girl's testimony, and that, frankly, she wasn't a good witness. She's only about five years old now.

This POS should not have gotten what has amounted to a slap on the wrist. Unfortunately, he will re-offend and someone else will become a statistic. This is simply reprehensible. But wait, there is more to this egregious miscarriage of justice at the hands of Judge Thomas Bartheld. He fined Earls $1,000. Geez, if that isn't the great deterrent to further crimes, then I don't know what else is? Of course, I am being sarcastic. This judge's record should be examined. Everyone knows that a judge does not have to accept any plea bargains hashed out by the prosecutor and the defense.

The district attorney is just as complicit in this man's one-year sentence as the judge is and if he was elected, he should be kicked out because he did not fulfill the duties of his office to the best of his abilities. Who in their right minds would expect a stellar testimony from a five year old kid? Parents have to be really careful about the people they allow around their kids.

Earls was initially accused of victimizing both the girl and her brother. But the charges involving the boy were dropped before Earls was scheduled to go to trial. The children’s mother blames herself for what happened to her children, and says she’s moving the family to another state as soon as possible. “They’ll never forget what happened to them,” she said.

The mother first met Earls in 2007. She said she felt uneasy about him watching her children and tried to look up his past on the Internet. She found only “something minor” and a protective order involving a former wife.

What she didn’t find were his convictions for shooting a man in 1982, or stabbing a woman in nearby Weleetka nearly 13 years later. She also didn’t discover that Earls had been in prison for six-plus years. Nearly a month after he admitted to raping and sodomizing her daughter, the mother seemed surprised to learn Earls had spent time in prison. Source: McAlester News-Capital
The system has failed society and this little girl. This is a devastating turn of events and the POS will be out running around the streets.
